LaunchSMS Privacy Policy

LaunchSMS (“LaunchSMS”, “we”, “us” or “our”) provides messaging, automation, and customer engagement tools to businesses. This Privacy Policy explains how we collect, use, disclose, and safeguard Personal Information when you visit our websites (including launchsms.com and app.launchsms.com), use the LaunchSMS platform and associated mobile or desktop apps, or otherwise interact with us (collectively, the “Services”). This notice applies to both information we collect as the controller (for our own business operations) and information we process as a processor on behalf of our customers. It should be read together with our Terms of Service.

1. Information We Collect

We collect the following categories of information about you and your end customers:

  • Account and Profile Data: name, company, job title, email, phone number, password and authentication data, preferences, and information you add to your profile.
  • Billing and Transaction Data: payment instrument details, billing address, tax IDs, subscription selections, and transaction history processed through our PCI-compliant payment providers.
  • Customer Content: message templates, SMS/MMS/chat/email content, attachments, media files, and metadata created or stored when you use LaunchSMS. This also includes contact lists, tags, notes, CRM data, and any custom fields you configure or import.
  • End Customer Information: names, phone numbers, email addresses, appointment details, form submissions, payment preferences, and other information supplied by our customers about their own clients. We process this data strictly according to each customer’s instructions.
  • Usage and Device Information: IP address, browser type, operating system, referring URLs, device identifiers, app log data, pages viewed, features used, and timestamps collected via cookies, SDKs, log files, and similar technologies.
  • Communications: feedback, support requests, survey responses, webinar attendance, sales calls, and correspondence with our teams. Calls may be recorded with notice.
  • Third-Party Sources: information from integration partners (e.g., CRM systems, scheduling tools), marketing platforms, identity providers, and publicly available sources to support onboarding, fraud prevention, lead enrichment, and compliance.

2. How We Use Information

We use Personal Information for the following purposes:

  • Provide, operate, secure, and troubleshoot the Services, including routing messages through carriers such as Twilio, tracking delivery, and managing phone numbers and contact lists.
  • Configure and personalize accounts, dashboards, automations, and integrations at your request.
  • Process payments, forecasts, invoicing, collections, and account management.
  • Monitor usage, perform analytics, measure campaign performance, conduct product research, and improve our Services.
  • Send technical notices, system updates, onboarding messages, security alerts, compliance notices, and administrative communications.
  • Provide customer support, respond to inquiries, and resolve disputes.
  • Market LaunchSMS offerings, run promotions, and deliver newsletters (you may opt out of marketing at any time).
  • Detect, investigate, and prevent security incidents, abuse, fraud, and violations of our terms, TCPA, CTIA, or carrier requirements.
  • Comply with applicable laws, regulations, legal processes, and enforce our agreements.

3. Legal Bases (EEA/UK/Swiss Users)

Where required, we rely on the following legal bases to process Personal Information: (i) performance of a contract (providing the Services and support); (ii) legitimate interests (securing and improving the Services, marketing to business contacts, preventing fraud); (iii) compliance with legal obligations; and (iv) consent, where we ask for it (e.g., sending certain marketing communications or storing optional cookies). When customers provide us with their end-customer data, they remain responsible for ensuring a lawful basis and providing required notices.

4. How We Share Information

  • Service Providers & Subprocessors: Telecommunications carriers, cloud hosting, analytics providers, payment processors, CRM or ticketing tools, and other vendors that assist us. These partners may be located in the United States or other jurisdictions and are bound by contractual and security obligations.
  • Customer-Directed Integrations: If you connect LaunchSMS to third-party apps (e.g., CRM, scheduling, or marketing platforms), we will share data as required to complete that integration.
  • Legal Requirements: We may disclose data when legally required, in response to lawful requests, to protect rights, safety, or to prevent fraud or abuse.
  • Business Transactions: In the event of a merger, financing, restructuring, or sale of all or part of LaunchSMS, data may be transferred with notice consistent with applicable law.
  • Aggregated or De-identified Data: We may share aggregated insights that cannot be used to identify individuals.

5. Customer Content & Contact Data

You control the data you import into LaunchSMS. We only use Customer Content to provide and improve the Services, fulfill your instructions, and meet legal obligations. We do not sell or rent end-customer contact lists. Where we process Customer Content on your behalf, you are the controller and we are the processor under applicable data protection laws. You are responsible for obtaining all necessary rights, consents, and lawful bases to process Personal Information through LaunchSMS.

6. Cookies and Similar Technologies

We and our partners use cookies, web beacons, pixels, and SDKs to remember preferences, authenticate sessions, analyze usage, deliver and measure advertising, and integrate with third-party services. You can adjust browser settings to refuse cookies, use industry opt-out tools, or manage preferences through any cookie banner we display. If you disable cookies, some features of LaunchSMS may not function properly.

7. Data Retention

We retain Personal Information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, protect our interests, and enforce agreements. Customers can control retention of Customer Content within the platform. We may also retain aggregated or anonymized data for analytics. When we no longer need Personal Information, we will delete or anonymize it.

8. International Data Transfers

LaunchSMS is based in the United States and processes data there. When we transfer Personal Information from the European Economic Area (EEA), United Kingdom, or Switzerland, we rely on lawful transfer mechanisms such as Standard Contractual Clauses, UK Addenda, or other safeguards permitted by law. Our subprocessors are required to implement comparable protections.

9. Security

We employ administrative, technical, and physical safeguards designed to protect Personal Information, including encryption in transit, network segmentation, monitoring, access controls, least-privilege policies, auditing, secure development practices, and regular vendor reviews. No system is completely secure, so we maintain incident response plans, encourage responsible disclosure, and will notify affected parties and regulators when required by law.

10. Your Rights & Choices

  • Marketing Communications: You can opt out of promotional emails by clicking “unsubscribe” or by contacting us. You may also text STOP to unsubscribe from specific SMS campaigns sent via LaunchSMS.
  • Account Settings: Administrators can update account information, manage contacts, or delete Customer Content at any time within the platform.
  • GDPR/UK/EEA Rights: Individuals located in the EEA/UK/Switzerland may request access, correction, deletion, restriction, portability, or object to processing by emailing privacy@launchsms.com. Where we process data on behalf of a customer, we will redirect your request to that customer.
  • CCPA/CPRA Rights: California residents may request to know, delete, or correct Personal Information, and may opt out of the “sale” or “sharing” of Personal Information. LaunchSMS does not sell Personal Information. Submit requests at privacy@launchsms.com or call 919-758-8420.
  • Do Not Track / Global Privacy Control: We honor legally recognized GPC signals for browser-based opt-outs when applicable.

11. Children’s Privacy

LaunchSMS is not directed to children under 16 and we do not knowingly collect Personal Information from them. If we learn that a child has provided us with Personal Information, we will promptly delete it. Please contact us if you believe a child has provided us data without appropriate consent.

12. Third-Party Links and Services

The Services may include links to websites, apps, or services operated by third parties. Their privacy practices are governed by their own policies, and we encourage you to review them. We are not responsible for the privacy practices of such third parties.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. If we make material changes, we will provide notice via email, in-app message, or by updating the “Last Updated” date above. Your continued use of LaunchSMS after the effective date of the revised policy constitutes acceptance.
